Description

As Litigation & Compliance Attorney, you will be responsible for managing and supporting a diverse range of litigation and pre-litigation matters, providing advice and counsel regarding regulatory compliance matters, as well as providing day-to-day legal advice to a variety of business units within the company. Litigation matters are likely to include product liability lawsuits, class action lawsuits, regulatory compliance actions, breach of contract and other business disputes, and responding to third-party subpoenas and government requests. The position supports VinFast’s global operations currently in the US, Canada, EU, and Vietnam.

RESPONSIBILITIES & KEY ACTIVITIES:

  • Provide legal advice to stakeholders on a wide variety of pre-litigation issues arising from business-as-usual activities, including advising business leaders and engineering teams on product liability, litigation risk, and regulatory compliance issues
  • Manage product liability (personal injury, warranty, property, etc.) and commercial litigation filed against the company, including selection of outside counsel and experts for the defense of cases
  • Interface with regulatory agencies (NHTSA, etc.) globally
  • Work and strategize with business units and outside counsel to help formulate and execute nuanced litigation strategy
  • Provide advice and counsel to Compliance and Homologation teams on all regulatory compliance and reporting issues
  • Direct and participate in managing and executing all aspects of arbitrations, mediations, litigation, and other matters (e.g., subpoenas, demands)
    • Conduct factual investigation, case analysis, exposure analysis, and legal research as needed
    • Hire and supervise outside counsel
    • Supervise and direct investigations of all property damage and personal injury claims involving company vehicles
    • Draft, review and revise pleadings and other litigation-related documents (e.g., declarations, motions, settlement agreements, etc.)
    • Help prepare witnesses for deposition
    • Develop defense, resolution, and trial strategies
    • Attend depositions, hearings, mediations, and trials
  • Maintain case files and matter tracking systems
  • Build cross-functional relationships to strengthen partnerships across the company
  • Identify and manage techniques to increase the quality and efficiency of legal services
  • Keep management and business units apprised of potential exposure on cases, regulatory compliance matters, litigation developments, and strategy
 
Position Requirements

MINIMUM REQUIREMENTS:

  • Juris doctorate (JD) degree and California Bar membership or ability to practice in California. In-house exception acceptable. Applicable advanced degree(s) a plus.
  • A minimum of 10-15 years of litigation and corporate legal experience. Law firm and in-house preferred but not mandatory. Electric vehicle industry, working for a foreign parent company, and startup background a plus.
  • Experience working with automotive regulatory agencies and provisions such as the TREAD Act globally.
  • Experience in all phases of litigation, including complex litigation and trial experience.
  • Experience defending clients in highly regulated industries with consumer products and services is a plus.
  • Experience cultivating relationships with internal stakeholders, parent company leaders, outside counsel, and relevant external governing and regulatory agencies.
  • Strong strategic and analytical skills

  • Strong interpersonal skills with ability to communicate and manage well at all levels of the organization.
  • Ability to work under pressure and with tight deadlines.
