Description

As Privacy Counsel, you will oversee the legal, compliance and privacy aspects of the activities of VinFast in the United States while being deeply involved in the business initiatives around the market launch of VinFast connected electric vehicles and other products and services. You will play a key role in protecting the reputation of VinFast by ensuring that legal guidelines are followed and providing detailed legal advice to the management and your business partners. You will cooperate closely with the US and Global Data Protection Officers and the VinFast global privacy and legal teams in your role as a member of the VinFast US legal department.

RESPONSIBILITIES & KEY ACTIVITIES:

  • Review, negotiate, and draft privacy language and documents, including commercial agreements, terms of use, data privacy agreements (DPAs), and data privacy impact assessments (DPIAs).
  • Provide legal support and guidance on privacy regulations applicable in the United States including the California Consumer Privacy Act of 2018 (CCPA) and US privacy industry best practices.
  • Provide guidance to technology teams and business leaders on the privacy, confidentiality, legal and other risks associated with the development, operation, and implementation of technology systems and innovations; work collaboratively with business partners to develop practical solutions to address risks.
  • Cooperate with the US and Global DPOs to implement standards, identify non-compliance, and propose remedies.
  • Participate in the management of data protection and data privacy disputes, including risk analysis, working with outside counsel, assisting with the Data Subject Requests (DSRs) internal process, collecting evidence, drafting letters and formal notices, and drafting and validating transactional protocols.
  • Present a monthly US privacy watch list.
  • Collaborate with local and global legal teams and with outside counsel as necessary to provide accurate and timely counsel on a variety of legal topics including compliance, commercial agreements, licensing and permitting, insurance, logistics, marketing, sales, and service.
 
Position Requirements

MINIMUM REQUIREMENTS:

  • A minimum of 7 years of legal experience, with at least 5 years in data privacy. This can include a combination of corporate and law firm positions. Automotive industry (including electric vehicle) background a plus.
  • Juris doctorate (JD) degree and California Bar membership. Applicable advanced degree(s) a plus.
  • Certified Information Privacy Professional/United States (CIPP/US).
  • Broad knowledge/experience in the following areas: the CCPA, the California Privacy Rights Act of 2020 (CPRA), industry best practices, and also familiarity with the evolving privacy regulatory landscape including the Colorado Privacy Act (CPA), Connecticut’s Data Privacy Act (CTDPA), the Utah Consumer Privacy Act (UCPA), and the Virginia Consumer Data Protection Act) (VCDPA).
  • Experience negotiating DPAs with data processors.
  • Experience cultivating relationships with internal stakeholders, parent company legal leaders, outside counsel, and relevant external governing and regulatory agencies.
  • Strong interpersonal skills with ability to communicate and manage well at all levels of the organization.
  • Ability to work under pressure and with tight deadlines.
  • Executive presence, confidence, and enthusiastic attitude.
  • Can-do mindset with high energy and strong work ethic.
  • Creative problem solver; not afraid to think outside the box.
  • Meticulous and thorough attention to detail.
