Description

SUMMARY:  The Group Legal Accounts Specialist deals primarily with consumer (and small commercial) special assets involved in the legal collections process.  A high level of communication between outside business contacts in other professions occurs on a daily basis.  Knowledge of the legal system, repossession requirements, foreclosure process, probate process, FDCPA, GLBA, and FACTA are essential in this position.  The associate makes recommendations for action to manager on a regular basis and to make business decisions to protect Arvest Bank’s interest. 

ESSENTIAL DUTIES and RESPONSIBILITIES includes the following.  Other duties may be assigned:

  1. Coordinate liquidation of travel trailers, recreational vehicles, and boats. Obtain retail market values and assign asking price to retail dealer. Manage relationship with dealer and collect adequate information for asset liquidation decisions.
  2. Identify probate cases involving Arvest customers. Perform a cost analysis and determine if it is financially feasible to file a claim in the probate case. Initiate a probate case if necessary when equity is present in collateral and prepare necessary documents for filing with court in order to protect Arvest Banks interest. Follow through with Probate until case closed.
  3. Review cost of participating in probate versus potential returns. Make decision if financially feasible to file a claim in the probate case. Prepare necessary documents for filing with court in order to protect Arvest Banks interest when determined appropriate.  Initiate Probate case if necessary when equity is present in collateral. Follow through with Probate until case closed.
  4. Determine equity position and if foreclosure/charge off is necessary upon expiration of 30 day real estate demand and collection of related information. When positive equity exists determine appropriate counsel for the case and refer account for initiation of foreclosure lawsuit. When Arvest purchases property prepare all associated forms and assist in determining rehabilitation, cleanup and liquidation of property.
  5. Upon expiration of 30-day real estate demand, collect information to determine equity position and decide if foreclosure or charge off is necessary. When positive equity exits, make decision on appropriate counsel and refer account to approved attorney in market area of collateral for initiation of foreclosure lawsuit. Follow up with counsel until sale date is obtained. Complete appropriate Foreclosure Bid Worksheet to review debt balance, fees, expenses, and valuation of collateral in order to determine proper bidding instructions to be provided to counsel. If Arvest purchases property, prepare Special Asset Workbook and ORE forms, take any identified loss. Assist in making decision regarding rehabilitation, cleanup and liquidation of property as needed. Assist with similar decision making on small commercial coded credits as needed. Assist with decision making during liquidation of in house AMC foreclosed properties as needed. 
  6. Review PMI insured loans in default. Determine the equity position in each property and if foreclosure action is needed, or if a claim for the full amount should be filed. If decision is made to foreclose, complete the process through liquidation of collateral and file claim with insurance provider on loss amount. If decision is made to file a claim on full balance, monitor the filing of the claim until funds are received.

EDUCATION and/or EXPERIENCE:

  • Associate Degree or equivalent related experience required.
  • Minimum 2 years previous lend experience required
  • 2 years in collection environment required

While performing the duties of this job, the associate is regularly required to stand, walk, sit, and to talk and hear. The associate must occasionally reach with hands and arms; stoop, kneel, or crouch.

Specific vision abilities required by this job include close, distance and color vision and the ability to adjust focus.
