Basic Function: Provides guidance, mentoring and counseling, and acts as a resource, on legal and regulatory-related claims consistent with Claims Handling Guidelines.

Directly montiors litigated claims and exposures at $100,000 or greater, or are handled in the Large Loss Unit.

May provide guidance, mentoring and counseling, on underlying claims, consistent with departmental guidelines, on matters listed on the Watch List.

Provides guidance, mentoring and counseling on policy and coverage interpretation. Provides legal analysis and opinions on coverage issues. Determines if the involvement of panel counsel is necessary to assist with coverage analysis.

Undertakes necessary legal research and provides legal direction on any matters relevant to claims handling. Disseminates information as needed.

Trains, develops and provides technical guidance to Unit, Regional, Divisional and Litigation Claims Managers and their staff on issues involving any legal or claims related issues.

Serves as Subject Matter Experts or Policy Operations, Marketing, Pricing and other departments.

Duties/Responsibilities:  Responsible for maintaining and growing a relationship between GMAC Insurance and current policyholders. Also responsible for focusing on the needs of loss participants. identifies customer needs and works to meet those needs using appropriate Point of Difference skills.

While directly montioring, provides guidance, mentoring and counseling and acts as a resource on litigated claims, claims with exposures of $100,000 or greater, and those that are handled in the Large Unit Loss.

Provides legal advice, oversight and counsel to claims personnel.

Promary responsbility in assuring appropriate execution of the litigation philosphy and litigation management guidelines to assure accuracy in litigation claim handling and optimization of legal expenses.

Acts as a liason between claims and house counsel.

May assist in organizing, facilitating and participating in file roundtables.

Responsible for the identification, hiring and performance management of panel counsel for defense, coverage, SIU and PIP specialites.

May directly handle complex declaratory judgment actions brought by or against GMACI underwriting companies.

Primary responsibility for determining post-verdict decisions. Directly handles appeals.

Reviews and provides recommendations on file handling, including but not limited to: investigation of coverage, liability and damages, evaluation, resolution strategy , and action plan, subrogation or suspicious claims and that appropriate execution of claims handlings occurs. Ensures appropriate functional areas within Claims are invovled.

Reviews and ensures that appropriate resreves are established and where they are not, provides recommendations regarding the same.

Has a proficient understanding of, and executes consistently with, GMAC Insurance Claims Handling Guidelines.

As as a Subject Matter Expert for Product, Policy Operations, Marketing, Pricing and other departments.

Required Skills: Maintains an active license as an attorney in at least one state.

Has expert knowledge of claims policies and procedures and/or providing technical direction to claims personnel for claims handling.

Has a minimum of five years of related work experience in a personal lines property & casualty insurance company or equivalent law firm experience focusing on personal lines insurance or coverage issues. Trial experience strongly preferred.

Requires a high degree of initiative, mature judgment, and discretion. Abillity to proactively resolve conflicts and empathsize with internal and external customers is critical. Claims strategic and negotiation skills are critical.

Demonstrates professional oral and written communication skills.

Demonstrates a sold understanding of the insurance industry and organizational relationship of the company. also, demonstrates a solid understanding of the functions of other departments, such as Policy Ops and Marketing. May assist on cross-functional projects.
