Job Description

Realty Paralegal

Summary: Working under the direct supervision of the Office of Tribal Attorney (OTA), the Realty Paralegal reviews contracts, researches law, investigates facts, and prepares documents and presentations to assist the attorneys with substantive and procedural matters. The Realty Paralegal assists tribal members with land assignment and residential lease applications, and prepares tribal documentation for approval and recording of the same. The Realty Paralegal tracks easements, service agreements, and utility and roadway rights-of-way served by the Tribe's Public Works Department and prepares tribal documentation for approval and recording of the same. The Realty paralegal shares administrative support duties for the OTA. The Realty Paralegal is expected to perform all responsibilities with a commitment to providing superior service to the OTA and the Tribe. With the direction and support of the OTA, the Realty Paralegal shares in the OTA's duties of confidentiality to the tribal client.

Work Location: Tribal Center Government Offices

Supervised by: Tribal Attorney

Work Schedule: M-F, 8:30am-4:30pm

Salary: $50,000 to $80,000/year depending on experience

Position Status: Regular, Full-time, Hourly with Benefits

Essential Duties and Responsibilities:

  • Fee to Trust Acquisitions
  • Establish positive working relationships with Bureau of Indian Affairs staff and serve as the main point of contact for the Tribe on fee to trust applications
  • Work with BIA office personnel and the Tribal Attorney to initiate, prepare applications, hire consultants to comply with federal requirements, monitor progress, troubleshoot problems, prepare reports and correspondence to BIA officials, package and deliver technical data, make frequent visits to ensure applications proceed in a timely manner, and ensure that fee to trust conversions are properly recorded with the BIA office and county governments, if required
  • Land Services to Tribal Members
  • Receive Land Assignment applications from community members; write lot descriptions; issue public notice of applications; and write resolutions for legal/policy review and approval
  • Receive and review Residential Lease applications from community members; complete Residential Lease (LEKT Res. 42-04), including legal description appropriate for Leasehold Mortgage (LEKT Res. 43-04); prepare resolutions for legal/ policy review and approval; file approved leases with US Department of the Interior, Land Title Records Office (LTRO); and reply to requests for information from lenders issuing Leasehold Mortgages
  • Coordinate Indian Health Service (IHS) Sanitary Facilities Construction services for community members, including processing government to government agreements and communication with IHS; accept, review for eligibility and process sanitary facility applications; and administer construction contracts
  • Easements and Rights of Way
  • Provide right of way agent services to secure, record and track utility easements, service agreements and road rights of way served by the Tribe's Public Works Department including water and waste water lines, public roads, and broad band fiber
  • Track utility easements, service agreements, and rights of way and record with LTRO as required
  • Environmental Compliance
  • Complete environmental permit compliance, as required for leases, rights of way, and other functions of this position. For example, prepare Housing and Urban Development (HUD) NEPA Documented Categorical Exclusion for Section 184 Indian Home Loan Guarantee Program
  • Other duties as required.
 
Position Requirements

Desired Qualifications (Minimum Required for Indian Preference in Hiring):

  • Bachelor’s Degree in public administration, legal studies, engineering, real property management, land planning, or related field; or Associate’s Degree in Administration, legal studies/ paralegal, technical engineering, public administration or closely related field and 3 years’ documented work experience in a combination of the fields such as title examiner, paralegal, engineering technician or real estate
  • Minimum 5 years’ experience working as paralegal
  • Ability to read, write and speak English
  • Ability to read, comprehend, and follow instructions
  • Excellent oral and written communication skills, including the ability to communicate potentially detailed and complex information to others
  • Thorough knowledge of legal communication principles and practices
  • Must possess basic knowledge of legal descriptions of various types to determine precisely where the land is located, acreage of tracts, etc.
  • Ability to store, organize, and maintain multiple formats (including automated systems of record) or data in a usable condition; assures information is readily available; disseminates information effectively and securely
  • Aptitude and willingness to work with complex procedures
  • Strong research skills, including via internet, databases, and other sources
  • General familiarity with local, state and federal laws, regulations, and concepts, and ability to gain in-depth knowledge as a situation may require
  • Ability to manage multiple priorities and adjust to changing priorities in a professional manner
  • Ability to meet deadlines in a fast-paced environment
  • Ability to work independently and with a team
  • Willingness and ability to assume new tasks and responsibilities
  • Strong service orientation and an ability to establish and maintain effective working relationships with attorneys, Tribal Council members, executive officers and staff, department directors and managers, secretaries and peers
  • Commitment to the office and Tribe
  • Proficiency in Adobe Acrobat and Microsoft Office applications, including Word, Excel, Outlook and PowerPoint
  • Must be able to pass a background check with:
  • No prior convictions for: child-related offenses; theft, fraud, bribery, extortion, perjury, embezzlement or conspiracy to commit any of the same; or any felonies;
  • No prior civil judgments for dishonesty, fraud, misappropriation of property or funds, or conversion; and
  • No reported instances of negligence in carrying out essential job functions
  • Must be able to comply with the Lower Elwha Klallam Tribe Drug Free Workplace policies, including pre-employment UA testing
  • Must possess a Washington State driver’s license within 30 days of employment, and meet Driver Qualifications set forth in the Tribe’s Motor Vehicle Operation Policy

Preferred Qualifications:

  • Administrative experience working for an Indian Tribal Government
  • Experience with and understanding of Federal Indian Law

Physical Requirements:

  • Regularly required to speak and hear
  • Frequently required to sit, stand, walk and use hands and fingers to handle or feel, and reach with hands and arms
  • Ability to see/understand colors, alpha numerical chart systems and visual acuity
  • Moderate lifting, occasionally 15-40 pounds
  • Must be able to work at a desk 8 hours a day
  • Must be capable of occasionally driving up to 8 hours in a single day
