The National Board for Certified Counselors (NBCC) is a not-for-profit, independent certification organization whose primary purposes are to establish and administer a national certification system and identify those counselors who have voluntarily sought and obtained board certification. NBCC is the premier certification body of the profession with a vision of enhancing society worldwide through quality counseling. NBCC and Affiliates is comprised of three organizational affiliates: the National Board for Certified Counselors (NBCC), the Center for Credentialing & Education (CCE), and the NBCC Foundation (NBCCF).

NBCC and Affiliates has operations and partnerships in approximately 40 countries providing professional certifications, occupational credentials, training programs, educational activities, and public mental health services through institutes and other service-oriented programs. Over 66,000 board certified counselors serve the public and advance mental health efforts across the globe. With a portfolio of nine credentials related to professional counseling, mental health, addictions, human services, and career development, NBCC and Affiliates seeks to expand the professional capacity of counselors and human service professionals.

NBCC’s primary organizational functions relate to the development and operation of quality credentialing, certification, and quality assurance programs. CCE creates and administers other occupational programs, including education and training activities, and leverages credentials to best serve communities. Additionally, CCE provides management and examination development services for associations, boards, agencies, and other organizational clients. NBCCF administers programs focused on capacity building, the expansion of access to mental health services in underserved and never-served communities, and the development of high-quality professional development resources for counselors, including the administration of graduate-degree scholarship programs.

Job Summary

The Legal Support Department is an important part of the NBCC Operations Division. The department works with all organizational affiliates and divisions as a shared service providing a range of legal support services related to contracts; professional ethics; organizational policies; intellectual property; certification and licensure; and business registration and regulatory compliance. The Staff Attorney will take on a variety of legal tasks to assist with these responsibilities.

Essential Duties and Responsibilities

The following duties and responsibilities are a summary of the essential functions of the job. Other duties might be performed that are not mentioned below. Specific activities could change periodically.

  • Provides legal support services to the General Counsel/Chief Legal Officer and the Director of Legal Support, including, but not limited to, the following:
    • Researches and collaborates on contract development and negotiations with state agencies and services providers.
    • Reviews and edits corporate policies and procedures.
    • Assists with the preparation of business registrations and related filings.
    • Represents the organization in corporate governance, organizational bylaws, administrative, intellectual property, ethics, and general business law matters.
    • Provides advice concerning organizational liability and insurance issues.
    • Works effectively with other NBCC and Affiliates’ departments concerning legal strategies.
    • Provides risk assessment analysis and recommendations to the organization and its affiliates.
    • Assists with intellectual property (trademark and copyright) registration, infringement, and licensing issues.
    • Provides legal expertise and guidance regarding certification program matters to include eligibility, examinations, and standards.
    • Reviews organizational publications, website content, and advertising and marketing materials to ensure compliance with legal requirements.
  • Learns new substantive legal topics and factual subject matters as needed based on the nature of a matter.
  • Develops and maintains relationships with other non-profit agencies, government officials and employees, and services providers.
  • Conducts administrative tasks as needed.
  • Adheres to program priorities and policies, procedures, and standards of practice, as well as the highest professional and ethical standards.
  • Keeps abreast of developments in the law and nonprofit field and disseminates information to staff.
