SUMMARY: The Health Center Counsel provides guidance and advice to the management team of Open Door Community Health Centers (ODCHC), providing legal review and strategies to protect and enhance the efforts of the corporation. The Health Center Counsel also serves as the Compliance Officer for the corporation with direct responsibility to the Board of Directors. The Health Center Counsel is responsible for assuring compliance with external regulatory and funding agencies. Working with subject-matter experts, managers and directors, Counsel guides the development of and compliance with internal policies and protocols. Counsel has oversight of ODCHC’s risk management, privacy and safety programs and serves as Chair of the Compliance Committee. Counsel reviews contracts, agreements and understandings and informs decision-making regarding local, state and federal laws and regulations and the likely impacts on the corporation. Counsel also reviews findings with internal and external auditors to assure compliance and implementation of corrective actions. Working with managers and executives, Counsel reviews unusual incidents, near-misses and patient or employee complaints and coordinates investigations as warranted. Counsel assists the Legal Affairs Director in working with outside counsel and litigators as necessary. Salary competitive, dependent upon experience.

 
Position Requirements

ESSENTIAL DUTIES AND RESPONSIBILITIES: The essential responsibilities are conducted within the context of strong interpersonal, verbal and written communication, including presentation and public speaking, as well as attention to detail and collaboration with diverse groups of staff, managers and senior leadership.

  • Maintain a strong working knowledge of, keep abreast of changes to and assure compliance with applicable federal, state and local regulations regarding health center operations;
  • Draft, review and revise draft contracts and other agreements related to the health center’s business relationships;\
  • Review and revise standard and boilerplate corporate documents; appropriately complete templated documents as necessary;
  • Coordinate the effort to design, implement, evaluate and improve policies, processes and strategies to prevent, detect, investigate and resolve compliance concerns;
  • Advise senior leaders and Board of Directors regarding advocacy issues at the private, state and federal level;
  • Working with subject matter experts, coordinate the development, management and periodic review of corporate policies and procedures, presenting revisions to senior leaders and Board of Directors as appropriate;
  • Seek to guide and inform balanced discussion of a variety of issues, considering the mission of the corporate in the context of the “spirit of the law” and the “letter of the law”;
  • Coordinate the corporation’s compliance and risk management programs, including but not limited to ensuring compliance with HIPAA, FTCA, HRSA, OSHPD, and other regulatory and accrediting entities;
  • Contribute positively to the efficiency, accessibility, productivity, quality, safety, compassion and professionalism of the work setting;
  • Adhere to ODCHC’s policies and procedures; and,
  • Other duties and responsibilities as identified and assigned by the Legal Affairs Director.

QUALIFICATIONS AND EXPECTATIONS: In addition to the education, experience and skills below, it is important for the successful candidate to be a good fit with the ODCHC mission and culture.

  • JD degree and active license to practice law in California;
  • Three years of experience as an attorney, ideally in a health care setting;
  • Demonstrated commitment to health center mission and to working with individuals from diverse backgrounds and experiences;
  • Experience and ability to remain current in local, state and federal regulations regarding health center operations and compliance, including funding and reimbursement requirements;
  • Ability to read, analyze and interpret implications of proposed regulations; ability to apply such changes to operational policies and protocols;
  • Understanding of mission-driven organizations; safety net organizations; non-profit organizations; and role of community health centers in health care and community infrastructure
  • Demonstrated thoughtful and inclusive decision-making processes;
  • Excellent interpersonal, written and verbal communication skills, including public-presentations
  • Excellent organizational and time management skills; ability to set priorities and meet deadlines;
  • Excellent computer skills, including ability to use word processing, spreadsheet, data management, web-based programs and conduct various analyses and comparisons using Excel;
  • Ability to effectively present information and respond to questions from participants, supervisors, managers, others within the corporation and the general public;
  • Ability to collaborate with others while working with minimal supervision;
  • Ability to maintain confidentiality and objectivity; and,
  • Valid and insurable California drivers’ license and reliable transportation.

SUPERVISORY RESPONSIBILITIES: The Health Center Counsel supervises the Risk Manager and the Healthcare Environment Specialist; Counsel is also instrumental in leading various committees, task forces and ad hoc activities with representatives of all aspects of the corporation.

SUPERVISION AND SUPPORT: The Health Center Counsel reports to the Legal Affairs Director and has a direct connection to the Board of Directors as necessary. Counsel will work with various subject area experts, department managers and senior executives as appropriate to the tasks at hand.

PHYSICAL REQUIREMENTS: This is largely an office-based position; however, travel among ODCHC sites is expected. The physical requirements described are representative of those needed to successfully perform the essential duties of the position.   • Speaking and hearing sufficient to communicate effectively by telephone, video or in-person at normal volumes;
  • Vision adequate to read documents, computer screens, forms and designs and to differentiate colors as necessary;
  • Ability to use standard office and computer equipment;
  • Ability to lift and carry packages and boxes weighing up to 25 pounds;
  • Ability to travel locally and long-distance by car and air;
  • Ability to sit or stand for extended periods of time;
  • Ability to use keyboard and view computer screens for extended periods of time; and,
  • Ability to move around offices and clinics as needed.
