JOB DESCRIPTION

POSITION TITLE: Legal Assistant/Paralegal

DEPARTMENT: City Attorney

DIVISION: City Attorney

REPORTS TO: City Attorney

GENERAL SCOPE

Under general supervision, performs complex and varied paralegal, secretarial, and office administrative duties for the City Attorney and Assistant City Attorney.

POSITION SCOPE

The City Attorney represents the City in all legal matters and is responsible for legal advice to all departments within the governmental unit of the municipality, and for prosecution of all municipal code violations. Utilizing a thorough legal assistant/paralegal background and a thorough understanding of legal procedures and knowledge of preparation of legal documents, the incumbent performs assigned functions for the City Attorney. The incumbent must utilize professional knowledge and communication skills to answer inquiries as able or direct them to the appropriate person. Work requires the independent exercise of judgment in accordance with established policies and the requirements of law, subject to general review and supervision. Sound judgment, based in a broad knowledge of areas of typical municipal law practice and general functions of the City of Kaukauna, is necessary.

ESSENTIAL FUNCTIONS

Prepares pleadings, briefs, letters, memos, and other legal documents in final form, working from computer generated drafts and templates of the City Attorney.

Assists City Attorney with legal research by locating applicable precedents, legal opinions, and statutes. Assist with trial preparation to include organization of exhibits, deposition abstraction, and witness subpoenas and notification. Review case records and assemble necessary information for legal proceedings. Draft written motions, discovery requests, response, and occasionally portions of legal opinions and briefs.

Establish case files and organize records and documentation; utilize electronic records management system. Engage with other city employees on city teams as assigned; assume role of team lead for law department teams as assigned.

Maintain Municipal Court prosecution records; prepare witness subpoenas, motions, petitions and orders for submittal to appropriate tribunal as needed.

Drafts and files real estate documents, basic civil pleadings, bankruptcy proofs of claim, probate claims, and small claims court documents in coordination with supervising attorney. Arranges for proper legal service.

Performs record filing, preservation, and retrieval functions, utilizing knowledge of the Public Records Law, to serve as record custodian for the department.

Attends agenda review meetings and assists the City Attorney and City staff in the preparation of ordinances and resolutions for presentation to the City Council.

Codifies all ordinance amendments and indexes resolutions enacted by the City Council.

Maintains the department's law library and assists the public and City staff with requests on ordinance and resolution history.

Talks to individuals contacting the legal office in person or by telephone. Ascertains the purpose of the call or visit and handles the matter personally if possible or refers to the appropriate official or attorney as warranted and appropriate.

Possesses a general knowledge of procedures and activities in the City's managements and administrative offices to assist administrative staff as needed.

The position is the primary point of contact for customers and clients of the City Attorney's Office. The incumbent must project a welcoming, customer service orientated attitude with an aptitude to triage incoming requests for assistance by assisting those within his or her ability and range of authority and distributing the rest among the attorneys in the office, or such other more appropriate point of contact, in a manner to facilitate timely response. Legal work product from the attorneys in the office is directed to the Legal Assistant/Paralegal who must be able to prioritize work flow while meeting all deadlines, seeking proper direction from the City Attorney. Incumbent must have the ability to handle multiple tasks efficiently and correctly to meet short term peak work demands with professionalism.

Position Requirements REQUIREMENTS
• Paralegal certificate from an American Bar Association accredited program preferred.
• At least three (3) years of law office or corporate legal department experience preferred.
• Excellent organizational, customer service, and problem solving abilities.
• In depth knowledge of legal terminology and principles, legal practices, and procedures including legal terminology, research, legal calendaring, business English, business document formatting, spelling, grammar, punctuation, vocabulary, filing, and arithmetic.
• Skill in multi-tasking required for fast paced multi-faceted legal needs of the municipal corporation.
• Ability to organize, schedule, prioritize, perform legal research, and accurately complete assignments within deadlines with limited supervision.
